Unless otherwise defined, capitalised words and phrases in these Terms and Conditions have the meaning set out in the Cricket Australia and Queensland Cricket policies referred to in these Terms and Conditions.
In these Terms and Conditions, Cricket Organisation means Cricket Australia, Queensland Cricket, Mackay Cricket, Bowen Cricket Club, and any affiliated associations and clubs, and Your Cricket Organisation means Proserpine Junior Cricket Association (PJCA).
The PlayHQ online registration form and these Terms and Conditions of Participation (which may be amended from time to time) (Terms and Conditions) are the conditions upon which you agree to register as a participant to play, umpire, administer or volunteer in cricket (Cricket Participant). By submitting a PlayHQ online registration form and paying the applicable registration fee, you (and, if you are under 18 years of age, you and your parent or legal guardian whose name and details appear in the requisite fields) agree to these Terms and Conditions. More specifically, you (and, where appropriate, your parent or legal guardian):
1.1. Agree to be registered as a Cricket Participant with Your Cricket Organisation.
1.2. Agree that the information provided by you is current and correct at the time of registration and will be updated by you as required within one month of any change.
Privacy and your personal information
1.3. Acknowledge that the personal information that a Cricket Organisation collects from you may be used and disclosed for the purposes of administering the game of cricket, including participation in competitions, programs and activities, and providing cricket-related services, offers and information.
1.4. To avoid doubt, acknowledge that the personal information that a Cricket Organisation collects from you may be used and disclosed to Cricket Australia, Queensland Cricket, Mackay Whitsunday Cricket and affiliated clubs and associations for the purposes of development, assessment and participation in pathway or representative cricket activities.
1.5. To avoid doubt, acknowledge that Cricket Organisations may use third parties, including IT providers, competition management systems, insurers and venue operators, to collect, store or process your personal information, or your information may be disclosed to third parties to assist in delivering cricket activities or as required by law.
Policies and Codes of Behaviour
1.6. Agree to be bound by and comply with all rules, regulations, constitutions and by-laws, codes of conduct, and policies of Cricket Australia, Queensland Cricket, Mackay Cricket and Your Cricket Organisation, including but not limited to Member Protection policies, Codes of Behaviour, Safeguarding Children and Young People policies, and the Spirit of Cricket.
1.7. The parent or guardian of the Cricket Participant acknowledges that they have read and will abide by the policies and codes of behaviour referred to above, and that any breach of those policies may result in disciplinary action under the applicable policies or procedures of the relevant Cricket Organisation.
1.8. Warrant that you have fully disclosed any suspension that you may be serving imposed by any cricket body or other sporting body, and that you have a continuing obligation to immediately disclose any suspension imposed in the future to Your Cricket Organisation.
Risk
1.9. Acknowledge and accept all risks involved in training, competing and otherwise participating in cricket activities, including but not limited to being struck by a cricket bat or ball, including impact to the head, falling or tripping, colliding with other participants, injuries arising from playing conditions, and environmental factors such as heat, humidity and storms. You acknowledge that accidents can and do happen which may result in personal injury, permanent disability or death, as well as the risk of illness. You confirm that you have considered these risks, including any personal vulnerability or health condition, and you will not participate while affected by drugs or alcohol. You acknowledge that this constitutes a risk warning under applicable legislation.
Weather and Program Delivery
1.10. Acknowledge that cricket activities conducted by Your Cricket Organisation are subject to weather conditions and ground safety, particularly in North Queensland where weather conditions can be unpredictable and change rapidly.
1.11. Acknowledge and agree that training sessions, matches and programs, including Junior Blasters and Master Blasters, may be cancelled, delayed or modified at short notice due to rain, storms, extreme heat or unsafe ground conditions.
1.12. Acknowledge that Your Cricket Organisation cannot guarantee that scheduled sessions or program dates will proceed as planned and that there are no guaranteed catch-up sessions for any cancelled Junior Blasters or Master Blasters sessions.
1.13. Agree that weather-related cancellations or disruptions do not entitle you to a refund, credit or transfer of fees.
Insurance
1.14. Acknowledge that the National Club Risk Protection Program provides insurance cover for certain costs arising from injury sustained whilst participating in cricket activities conducted by Cricket Organisations.
1.15. Acknowledge that this insurance provides a basic level of cover only and does not cover all costs, including any amounts claimable through Medicare, and that reimbursement is subject to the terms of the policy.
1.16. Acknowledge that this insurance is not comprehensive and that you are responsible for considering your own insurance needs in relation to participation in cricket activities.
Medical
1.17. Warrant that you do not have any known medical or other condition which makes it unsafe to participate in cricket activities and agree, if requested by Your Cricket Organisation, to provide medical clearance confirming fitness to participate.
Cancellation by you and refunds
1.18. Must notify Your Cricket Organisation in writing if you wish to cancel your registration, and upon confirmation of cancellation you will no longer be entitled to participate or receive any benefits of registration.
1.19. Registration fees are non-refundable and Your Cricket Organisation is under no obligation to provide a refund except where required by law or at its discretion.
Use of name and image
1.20. Consent to Cricket Organisations and their representatives, affiliates and partners to record, use and reproduce your name, image, likeness, voice or biographical information in any form or medium for the purposes of administration, promotion, marketing and development of cricket, and agree that no payment or compensation will be provided for such use. If you do not consent, you must notify Your Cricket Organisation in writing, noting that this may affect your ability to participate in certain activities.
Refusal, suspension or cancellation
1.21. Acknowledge and agree that Your Cricket Organisation reserves the right, in its discretion, to refuse, suspend or cancel your registration at any time.
1.22. Acknowledge that such action may occur in circumstances including, but not limited to, where false or misleading information has been provided, where you are under suspension or investigation, where you have breached policies or codes of conduct, where there are outstanding debts, where your conduct poses a risk to others, or where you are not considered a fit and proper person to participate in cricket activities.
1.23. Agree that Your Cricket Organisation is not required to provide detailed reasons for any such decision and that no refund will be provided where cancellation or suspension results from misconduct.
Additional terms
1.24. Acknowledge that Your Cricket Organisation may apply additional terms and conditions in relation to participation and registration from time to time.
